Terms and Conditions

1. The use of Bethera products implies full and unreserved acceptance of each and every one of the provisions included in these Terms and Conditions of Use, as well as in the Privacy Policy of the products belonging to the Bethera company.

2. Bethera reserves the right to change the Terms and Conditions and the Privacy Policy from time to time, so the User should consult the current documents before using the service. If the User does not fully agree with their provisions, the User should not use the service.

3. Any functionality that modifies, improves or extends the current service, including the launch of new tools, is subject to the conditions set out in the General Terms and Conditions and in the Privacy Policy.

4. Failure to comply with any of the conditions set out in the Terms and Conditions entitles Bethera to terminate the contract and prevent the user from using the service.


RESPONSIBILITY​


1. El Usuario se compromete a que toda la información facilitada sea veraz, exacta, completa y no engañosa en ningún aspecto relevante, a utilizar el servicio exclusivamente para los fines descritos en este acuerdo, y a comunicar al equipo de Bethera cualesquiera hechos y/o circunstancias que pudieran afectar de cualquier modo a sus derechos o a los derechos de terceros, autores u otros. 1. The User undertakes to ensure that all information provided is truthful, accurate, complete and not misleading in any material respect, to use the service exclusively for the purposes described in this agreement, and to inform the Bethera team of any facts and/or circumstances that may affect in any way their rights or the rights of third parties, authors or others.

2. The User undertakes to use his best efforts, always acting with the utmost diligence in the use of the service, to comply with the purposes of this agreement and not to denigrate Bethera's products.

3. The User understands and accepts that Bethera is not responsible for any content entered and displayed during the use of the service.

4. Bethera no reconoce ni se hace responsable de los errores o retrasos que se produzcan por fallos imputables al Usuario o al sistema o fallos (temporales o permanentes) de aplicaciones u otras herramientas, cualquier pérdida de datos, retrasos o cualquier otra circunstancia o hecho imputable a terceros o a Internet que pueda afectar al acceso y/o desarrollo del servicio, ni se hace responsable de los daños derivados de la utilización, o imposibilidad de utilización. 4. Bethera does not recognise and cannot be held responsible for errors or delays that may occur due to errors attributable to the User or the system or failure (temporary or permanent) of applications or other tools, any loss of data, delays or any other circumstance or fact attributable to third parties or the Internet that may affect access to and/or development of the service, nor is it responsible for any damages resulting from the use, or inability to use.

5. Bethera is not responsible for any errors that the User or its employees may make when providing their personal data and, in particular, is not responsible for errors that may occur in the service when they result from incorrect, incomplete or erroneous indication of the data requested from the User.

6. Bethera cannot be held liable for any loss or damage resulting from unauthorised access by third parties, with the User acknowledging that Bethera's products are perfectly equipped with all appropriate and adequate security measures for the protection of their data, and the User undertakes not to compromise the security of the system through negligent, incorrect or inappropriate use of the system and services.

7. The User expressly understands and agrees that Bethera cannot be held liable under any circumstances for any direct, indirect, pecuniary or non-pecuniary damages, except in cases of intentional or fraudulent acts on the part of Bethera, including but not limited to: damages for loss of profits, damages for misuse, indirect losses, any tangible or intangible damage resulting from the use of the service or any other damages of any kind.

8. Bethera also disclaims any liability for any failure or delay due to force majeure, including but not limited to war, terrorism, state of emergency or catastrophe (including natural disasters), computer virus infection, bugs, alterations, unauthorised interventions, technical failures, affecting the performance of its obligations under this Agreement.

9. The User or third parties cannot hold Bethera liable in contract, tort, criminal or any other way for any modification or alteration of prices, suspension or termination of the service.

RESTRICTIONS ON THE USE OF BETHERA APPS


When using Bethera apps, the User undertakes not to:


- Using any mechanism, computer programme or technology to interfere or attempt to interfere with its normal operation;

- Sending or transmitting illegal, fraudulent, defamatory or obscene information to apps;

- Sending or transmitting information containing viruses or bugs to apps;

- Publish, represent, distribute, create derivative works from, reproduce or use the content of the apps (excluding use expressly and previously permitted);

- Sending or transmitting information that infringes the intellectual property rights of third parties;

- Engaging in any activity that puts excessive strain on the apps' infrastructure;

- Inserting, hosting, uploading, transmitting or sending unsolicited "spam" messages (a "message" being any email, SMS or data entered into the system);

- Display any part of the content of the Apps using framing, links or other technology without the express written authorisation of Bethera.


PAYMENTS AND REFUNDS


Services are charged in advance, according to the periodicity contracted (monthly or annually). There will be no right to a refund or credit whenever (i) the service subscription is cancelled, (ii) the subscribed plan is upgraded, or (iii) there are periods of non-use of the apps or non-access to the Personal Area.


The User must pay for the contracted service by ATM reference. The prices associated with the service subscription are shown in Euros and include the applicable VAT rate.


At the time of renewal, if the amount contracted in the previous subscription is lower than the current list price, it will be increased by a maximum of 7%. It will be subject to a 7% increase on new renewals until it reaches the current list price.
